A temporary infestation of rats, mice, ants, cockroaches, wasps or any form of pest will cause an inconvenience to tenants and may also result in damage to the property.

Infestations should be dealt with as soon as they are discovered. However, in these circumstances it is important to establish whether the landlord or tenant is responsible for dealing with the infestation.

If the property inhabited by the pests before the tenancy was granted, it is likely that the landlord will be responsible for dealing with the infestation.

Similarly, if the infestation occurred during the tenancy, then the landlord is unlikely to be responsible.

However, if the landlord has failed to keep the structure and exterior of the property in good repair and therefore allowed pests to enter the property (e.g. through a hole in the brickwork or pipes), then they would be responsible for addressing the problem.
